There is a personal account from an eyewitness of the accident posted on TGR.
If the account is correct then clearly the boarder in this situation was in the wrong.
The take-away for every snow slider is that there are things we can all do to make the slopes safer for everyone. No matter what the skier conduct code says we should all consider the safety of our actions when on the slopes - whether you're part of the uphill traffic or the downhill traffic. If you want to avoid injury be mindful of where you stop, where you turn, and always consider what might be on the other side of any blind spots.
