SUBJECT: General Liability - West Virginia Grants Statutory Immunity to Ski Patrol Volunteers
SUMMARY: West Virginia House Bill 2406 adds a new section in Article 7 of Chapter 55 of the Code of West Virginia. The new provision, Section 55-7-16, grants ski patrol members in good standing of a national ski patrol system statutory immunity for damages that result from their acts or omissions while rendering emergency care to an injured or ill person at a ski resort. Immunity attaches so long as the member acted in "good faith" in rendering emergency assistance. The law becomes effective on June 4, 2003.
