That "logic" is flawed. Last I checked, killing someone grossly affects the dead persons pursuit of happiness. As would drumming at 3 am. I believe that the rule that is applied in these cases is whether or not the activity is (1) legal, (2) grossly affects anothers pursuit of happiness. That covers killing and sleep deprivation. Not to mention that there are noise bylaws everywhere.
Personally, I don't see the need to ban smoking resort-wide, when butt-stops prior to getting into a lift line or inside a building would suit the bill.
I am a HUGE believer in not having to support medical expenses caused by smoking. But, so long as whatever is being done is still legal, I have to.
Same rules for overeating or over boozing apply to ski injuries too. As long as eating, drinking and skiing are still legal, gov't sponsored medical systems need to take care of all related injuries.
