They win the negligence issue and that ruling effectively awards them the right to stay in business.
Vail either sublets the property or awards POWDR a management/operating contract.
The cost to POWDR for operating on the terrain goes up but is prohibited by the negligence award from being fatally high.
One Wasatch happens and everyone is happy.

No. A PCMR win means a PCMR win. If rulings are overturned, Katz would then go back to goals Bistricer & Cumming had before the whole mess started, which is linking the resorts and pushing for the interconnect (now One Wasatch). Wealth is about power for Ian Cumming, and ego for his son. For Katz, this is about growing the business. He isn't worried about keeping a running tally of with his personal wealth just like Mitt doesn't. Katz has no issue with coopetition.
